2.Micromax Mobile, situated at plot No.637, Udyog Vihar, Gurgaon through its Managing Director.

                   Sh.Ashwani Popli Advocate for the Opposite Parties.

ORDER:                  

                        The learned counsel for the Opposite Parties made statement that the Opposite parties are ready to  pay Rs.7500/- after deducting depreciation out of the  cost of the mobile phone which was Rs.11000/- subject to deposit of old mobile phone  alongwith accessories with the Opposite Parties. Thereafter, the learned counsel for the complainant made statement for withdrawal of the complaint by submitting that the complainant has returned the old mobile phone alongwith accessories to the Opposite Parties before this Forum and he does not want to pursue with the present complaint. Statements of both the parties have been recorded separately.

2.                 In view of the statement made by the learned counsel for the complainant, the present complaint is dismissed as withdrawn. However, the Opposite Parties shall be bound by their statement. The parties concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
