Parties have compromised. Today Statement of Sh.Aditya Jain, Advocate Counsel for the Opposite Party No.2 recorded that the Opposite Party No.2 is ready to pay Rs.25,000/- + Rs.3000/- i.e. cost imposed by this Hon'ble Commission to the Complainant as full and final settlement, subject to condition that complainant will return the mobile handset in question along with accessories at the time of receipt of the demand draft and further Complainant will withdraw of the present complaint today. The OP No.2 will issue the Demand Draft of Rs.28,000/- as detailed above within 20 days of the receipt of copy of the final order.
Similarly, Sh.K.K.Gupta, Advocate Counsel for the Complainant recorded that he accept the offer given by Counsel for the OP No.2 and he does not want to persue with the present complaint, subject to fullfilment of terms & conditions of the offer made by the OP No.2 and same may be decided accordingly.
In view of the statement given by Ld. Counsel for the Complainant as well as Ld.Counsel for OP No.2, parties have settled the matter by way of amicable. So, accordingly the complaint of the complainant is disposed of with the direction to the OP No.2 to pay Rs.25,000/- + Rs.3000/- i.e.cost imposed by this Hon'ble Commission to the Complainant as full and final settlement, subject to condition that complainant will return the mobile handset in question along with accessories at the time of receipt of the demand draft. Further the OP No.2 is directed to issue the Demand Draft of Rs.28,000/- as detailed above within 20 days of the receipt of copy of the final order. As per Order dated 15.12.2020 of this Commission Cost of Rs.2000/- not deposited by the OP No.2. The Opposite Party No.2 is directed to deposit cost of Rs.2000/- in the Distict Legal Aid Fund of this Commission within a week. Copy of this order be supplied to the parties free of costs as per rules. File be consigned to the record room.
