This case record has been placed before the ld. Judges of Upobhokta Lok Adalat which is held on this day at the court room of D.C.D.R.C., Hooghly.
Both sides and their ld. Lawyers are found present.
Heard ld. Advocates of both sides. Considered submission.
As per submission of ld. Advocates of both sides the total amount of rent of Rs. 63,000/- which has been paid by the D/hr. have not yet been paid by the J/dr. to the D/hr.
In course of hearing and from discussion it is settled that the J/dr. shall pay Rs. 35,000/- to the D/hr. Arunanshu Chakraborty in two installments of Rs. 17,500/- each out of which the first installment is to be paid on 20.4.2023 and the second installment amount is to be paid on 20.7.2023.
It is settled that the D/hr. shall withdraw the possession letter and maps of the flat which have been filed by the J/dr. and lying with this case record.
D/hr. is given liberty to withdraw the bank draft bearing no. 177508 which has been deposited in the name of Banani Chakraborty of Rs. 15,000/- of State Bank of India which is lying in the safe custody of Registrar, DCDRC, Hooghly as early as possible.
In the light of the settlements described above this case is disposed of.
In the result, it is accordingly,
Ordered
that this execution case no. 32 of 2019 be and the same is disposed of as it is settled subject to the following conditions;
- J/dr. shall pay Rs. 35,000/- to the D/hr. in two equal installments of Rs. 17,500/- each out of which the first installment if to be paid on 20.4.2023 and the second installment is to be paid on 20.7.2023.
- D/hr. is given liberty to withdraw the possession letter and map of the flat by giving proper receipt before this District Commission.
- D/hr. is given liberty to withdraw the bank draft bearing no. 177508 which has been deposited in the name of Banani Chakraborty of Rs. 15,000/- of State Bank of India which is lying in the safe custody of Registrar, DCDRC, Hooghly as early as possible.
Let a free certified copy of this order be handed over to the parties immediately.
