An Application has been filed by the complainant for substituted service upon OP No.1  which has been registered as MA 347/2017 and  the instant petition has been fixed on 28.03.2018 for hearing.

Perused the petition and the related documents.

It appears from the petition and other materials on record that notice upon OP No 1 could not be served in ordinary way. The other OPs i.e. OP No 2 to 7 appeared before this Forum.

The complainant submitted that the OP No. 1 is a necessary party to the case and notice could not be served upon him by way of ordinary manner and therefore substituted service by way of paper publication is necessary.

In view of the facts and circumstances we are of the view that the case is being delayed due to non-service of notice upon OP NO. 1 and the petition of the complainant may be allowed.

Hence

 The petition of the complainant is allowed.

The MA being No. 347/2017 is allowed and disposed of.

Complainant is directed to file a draft copy of paper publication before this Forum for verification and the office is further directed to verify the same and handover to the complainant for publication. The complainant is further directed to publish the notice in a daily newspaper circulated in the area where the OP resides or carries on business.

 It is further directed that the publication notice should mention that the OP shall file written version within 45 days from the date of receipt of notice/paper publication.

 Office is directed to comply the Order.

To   29.06.2018 for filing publication copy by the complainant.
