1. File taken up today in terms of the order dated 20.09.2022 passed in miscellaneous application No.86 of 2022 filed separately by OP No.1 & 2 for referring the matter to Lok Adalat in view of the amicable settlement. 2. With the efforts of Upbhokta Lok Adalat, the parties have settled the matter. Vide his separate statement, counsel for OP No.1 & 2 has stated that as per settlement, the OP No.1 & 2 have agreed to pay lump sum amount of Rs.60,000/- to the complainant as full and final settlement within 45 days from today and it is further settled that in case the aforesaid amount is not paid by the OP No.1 & 2 within the stipulated period, the complainant shall have right to recover the aforesaid amount alongwith interest @ 9% p.a. from today by way of execution. Vide his separate statement, complainant has admitted the statement of counsel for OP No.1 & 2 and prayed that the complaint be disposed of in terms of aforesaid settlement. 3. In view of the statement of the parties and in terms of the settlement, the following award is passed:- (i) The OP No.1 & 2 are directed to pay lump sum amount of Rs.60,000/- to the complainant as full and final settlement within 45 days from today. (ii) In case the aforesaid amount is not paid by the OP No.1 & 2 within the stipulated period, the complainant shall have right to recover the aforesaid amount alongwith interest @ 9% p.a. from today by way of execution.
4. The award is accordingly passed. The miscellaneous application No.86 of 2022 stands disposed of accordingly. 5. Certified copies of this order be sent to the parties free of cost. The file be consigned. |
