The case is fixed for argument.
After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The Complainant’s case is that he booked an order with O.P. for purchase of one 37.25 HP Agricultural Tractor on 29/04/2019 for Rs.7,15,000/- out of which he deposited initially Rs.10,000/- and thereafter paid Rs.60,000/- on 20/05/2019. Before delivery of the Tractor the Complainant fell ill of chronic disease and expended huge amount for medical treatment and so he decided not to purchase the said Tractor and requested O.P. for return of advance money of Rs.70,000/- verbally and in writing but to no effect. Hence this case.
O.P. contested the case by filing a written version admitting the receipt of Rs.70,000/- but contending that they are not liable to refund the entire advance money and they are ready and willing to pay to the Complainant after deduction of GST and other Processing charges.

-: Decision with reasons: -
Having regard to the facts of the case, submission, contention and the documents on both sides the Commission finds that on the prayer of both sides the case was referred to the National Lok Adalat twice on 09/12/2023 and on 09/03/2024 for settlement with the offer of Rs.50,000/- but the same was not accepted by the Complainant. At the time of hearing Ld. Advocate for the Complainant has submitted that the Commission should pass order for return of the entire advance money of Rs.70,000/- with compensation but the Ld. Advocate for the O.P. did not agree with the same but offered to pay Rs.50,000/- in view of deduction of GST and other Processing Charges. But the documents as produced on behalf of the O.P. at the time of hearing relating to GST deduction does not relate to the transaction in question.
Considering the entire facts and circumstances of the case the Commission fixes the liability of the O.P. at Rs.55,000/- for payment to the Complainant.
Hence it is ordered……
That the case be and the same is disposed of on contest by directing the O.P. to pay to the Complainant Rs.55,000/- within one month from this date in default law will take its own course.
Both parties be supplied copy of this order free of cost.
