1.                     These two appeals have arisen out of one and the same order dated 26.10.2009 whereby the respective complaints were dismissed being frivolous with costs of Rs.10,000/-.

2.                     Without going into any further details, suffice it to say that at the very outset of his arguments, the learned counsel for the appellants/complainants, who are husband and wife, has fairly stated that he does not press the other grounds of appeals except that of the cost of Rs.10,000/- imposed in each complaint.

3.                     A perusal of record shows that here in the instant case, inspite of ample opportunities given to the OPs, no reply was filed. The copy of orders passed on the same issue have been placed on file, which indicate that earlier similar complaints filed by these very complainants were dismissed. It is fairly stated by the learned counsel for the appellants/complainants that the complainants have now continued the policy during the pendency of these two matters before this Commission. In this view of the matter and taking an overall view of the facts and circumstances, we feel that the order with regard to imposing of cost while dismissing the complaints is harsh and deserve to be set aside. So, we order accordingly. With this modification in the impugned orders, both the appeals are hereby dismissed. The amount of Rs.5,000/- deposited in each appeal while filing the appeals be refunded to the respective appellants/complainants against proper receipt and identification.

4.                     Copies of this order be sent to the parties free of charge.
