- We have heard Shri Ramnesh Jerath, Counsel for the Appellant.
- Present appeal is directed against the order dated 29.5.14 passed by the Ld. District Forum, Saini Enclave, Delhi.
- In brief, the vehicle Renault Duster HP RXL 85 PS was purchased by the complainant on 07.06.2013. The vehicle had run 2000 km when its engine seized on 28.10.2013. Ld. District Forum dismissed the complaint observing that it was simply a case of defect in the bottle of coolant.
- Perusal of the complaint shows that the complainant has alleged that there was an “engine collapse”. Be that it as may, matter requires adjudication. In the circumstances, matter is remanded back to the Ld. District Forum with the directions to dispose of the same on merits in accordance with law. Appellant to appear in the District Forum, Saini Enclave, Delhi on 19.11.2014.
