Heard Sh. Bhumesh Sharma – revisionist, who is present in person, on admission.

This revision petition has been preferred by the revisionist against the order dated 08.05.2018 passed by the District Forum, Udham Singh Nagar in execution application No. 01 of 2018, whereby it was directed that in case the revisionist approaches the opposite party during the pendency of the appeal before this Commission, the possession of the flat in question be delivered to him and the opposite party shall also issue the possession certificate in favour of the revisionist. 

Revisionist has submitted that he does not want to take possession of the flat unless and until the opposite party executes the sale deed of the flat in favour of the revisionist.

We have perused the impugned order passed by the District Forum.  The appeal is pending before this Commission for final adjudication.  It is the wish of the revisionist either to take the possession of the flat or not.  We do not find any infirmity in the impugned order passed by the District Forum.  The revision petition has got no force and is liable to be dismissed.

Revision petition is dismissed summarily at the threshold.
