    1. The complainant represented. Heard the authorised representative of the complainant. The complainant a Private Limited Company purchased the Generator Set from the opposite parties for commercial purpose.

     

    2. The complainant has nowhere pleaded in the complaint that the business is having conducted as self-employment for livelihood. Nor has it been alleged that the goods supplied by the opposite parties were being purchased of exclusively for the purpose of livelihood by means of self-employment by the complainant. This view stands fortified by the pronouncement of the Apex Court in Economic Transport Organization Vs. Charan Spinning Mills Pvt.Ltd. and another 2010 CPR (SC) (CP) 379.

     

    3. Accordingly, the proceedings in this complaint stands closed with a direction to the complainant to receive back the complaint and the related documents to be filed before the appropriate authority, if so advised.

     

    Pronounced in the open Forum on this the 4th day of June 2014.
