ORDER

 

Vide order dated 23.05.2023 complainant had sought liberty to withdraw the present case and file it before appropriate court since it is very clear written in the collaboration agreement dated 24.05.2015 entered between the parties in clause 8 thereof that first party and second party shall have right to enforce specific performance through courts of law if any of the party neglect or refused to perform his part of the contract. Since it is a civil dispute pertaining to specific performance governed by specific relief act, therefore, the complaint is dismissed as not maintainable with liberty to file before appropriate civil court. File be consigned to record room.
