Apple A Day Properties, Apple Tower, Palarivottom, Edappally, Kochi – 24 ORDER JUSTICE SHRI.K.R.UDAYABHANU : PRESIDENT The complainants/husband and wife had paid for Flat No. D122 in the fourth floor of the apartment building by name Apple Ice, proposed to be built by the opposite parties. It was assured to handover the flat in June, 2009. Altogether a sum of Rs. 13,45,330/- was paid. It was subsequently realized that the opposite parties are not taking any effective steps to complete the project and has stopped the work by August, 2009. The complaints have sought for refund of Rs. 13,45,330/- with interest at 18% and a compensation of Rs. 10,00,000/- The opposite parties stood Ex-parte. The first complainant has filed proof affidavit and got marked Exts. P1 to P7. Exts. P1 is the copy of the Sale Agreement dated 4.4.2008 and Ext. P2 is the copy of the Agreement for construction even dated and Ext. P3 is the letter confirming the booking dated 22.11.2007. Ext. P4 to P7 are the Bank receipts with respect to the payments made which altogether amount to Rs. 13,45,330/-. we find that the complainant has proved above payments with respect to the flat agreed to be handing over and that the opposite parties have failed to carryout the undertaking. In the circumstance, the opposite parties are hereby ordered to refund a sum of Rs. 13,45,313/- to the complainant with interest at 18% from the respective dates of payments as evidenced by Exts. P4 to P7 ie. Rs. 4,03,608/- paid on 27.1.2008 and Rs. 4,00,000/- paid on 1.04.2008 and Rs. 2,72,680/- paid on 20.6.2008 and Rs. 2,69,072/- paid on 28.10.2008. The complainant will also be entitled for cost of Rs. 5,000/- The complaint is allowed as above. JUSTICE K.R.
