Present:    Main Counsel for complainant is not                      present and counsel for OP.

                Arguments heard.

        The complainant entered into an agreement in the project of OP. The complainant got transferred this flat in the name of some other person and made the entire payment to the OP.  The allotted flat had an excess area of 72 sq.ft against the original area of 1746 sq. ft. and the payment was made by the complainant for extra area.  He was also charged some interest on the delayed payment and holding charges after taking possession of the same on 25.03.2008.  This complainant was filed in which the increased area is in question and the charges for interest and holding.  OP has filed reply stating that after having made the payment and taking possession, it is claimed that he is not a consumer.  The OP has also taken us to the agreement between the earlier transferor of OP and the agreement executed in area, interest on delayed payment and holding charges. We do not find any deficiency on the part of OP.  The complainant filed a complaint in frivolous manner and raises the case without any reason. Now, the case is dismissed.
