उभय पक्ष के विद्वान अधिवक्‍तागण को सुना। इस न्‍यायालय द्वारा पूर्व में दिनांक 20.12.2022 को निम्‍न विस्‍तृत आदेश परित किया गया है:-

''पुकार की गयी। परिवादी की ओर से विद्वान अधिवक्‍ता श्री प्रतुल श्रीवास्‍तव उपस्थित हुए। विपक्षी की ओर से विद्वान अधिवक्‍ता श्री संजीव बहादुर उपस्थित हुए। प्रस्‍तुत वाद में इस न्‍यायालय द्वारा दिनांक 23-11-2022 को उभय-पक्षकारों के विद्वान अधिवक्‍ताद्व्‍य को सुनने के उपरान्‍त पूर्व पारित आदेशों को उल्लिखित करते हुए निम्‍न आदेश पारित किया गया:-

            The instant complaint has been filed before this Court and is registered as Complaint Case No. 191/2019 with the following prayer:-

            “The most respecdtfully complainant prays for the following reliefs:

  1. To direct the opposite parties to get payment of the agreed penalty charges @ Rs.33,500/-  per month w.e.f. 01-05-2013 till possession of the allotted flat.
  2. To direct the opposite parties to get the interest charges @ 18% on the agreed due amount of penalty against delayed possession of flat.
  3. To issue direction to the opposite parties to hand over the physical possession over the allotted flat.
  4. To issue a direction to the opposite parties to pay Rs.2,00,000/- as damages for mental and physical harassment.
  5. To direct the opposite parties to pay for the cost of litigation as Rs.25,000/- of this complaint.
  6. Any other relsief which this Hon’ble Commission deems fit and proper for the proper adjudication of the case.”

              The brief facts of the case are that the opposite party M/s K. G. Constructions has proposed a scheme in the name of ‘CELEBRITY GREENS’ which situates at Ansal API Sushant Golf City, Lucknow. The complainant booked a flat on 30-12-2011. The unit/flat has been allotted by the opposite party being Flat No. M-403. The payment plan was settled between the parties as cash down payment plan. The basic price of the aforesaid flat has been settled to the tune of Rs.33,50,000/-. Accordingly an agreement has been executed in between the parties and the total sale consideration of Rs.33,50,000/- was paid/deposited by the complainant to the opposite party No.02 M/s K. G. Constructions on 31-01-2012.

              For purchase of the said unit/flat the complainant took the loan of Rs.20,00,000/- from HDFC Limited against assurance of opposite parties to give the possession of the flat within 15 months of complete payment which according to the complainant was made on 31-01-2012 and the 15 months period, therefore, expired on 31-03-2013.

              The opposite party No.02 has issued a letter dated 30-12-2011 addressed to the complainant which is enclosed as Annexure-2 to the complaint. The copy of the said letter is scanned herein below.

From the perusal of the said letter dated 30-12-2011 the opposite party No.02 has clearly mentioned the period of possession being 15 months from the date of completion of payment of the unit and it is further clearly mentioned in the said letter that in case of delay on the part of the opposite party No.02 in handing over of the possession the allottee shall be liable to penalty at the rate of 1% per month of the total deposited amount.

         It is further clearly mentioned in the said letter that the said penalty shall be paid by K. G. Constructions to the allottee. Admittedly the conditions stipulated in the said letter dated 30-12-2011 has not been fulfilled nor the opposite parties completed the construction of the plan/project till 2016. The concerned development authority has not issued the Completion Certificate/Occupancy Certificate.

         During the course of hearing of the present case on the previous date i.e. on 04-11-2022 this Court has passed the following order with the consent of learned Counsel for the parties.

प्रस्‍तुत परिवाद एवं परिवाद सं071/2022 में विपक्षी कम्‍पनी की ओर से सर्वश्री रोहित चंद्रा एवं श्री मानवेन्‍द्रप्रताप सिंह विद्वान अधिवक्‍ता द्व्‍य को सुना। परिवादी की ओर से सर्वश्री प्रतुल श्रीवास्‍तव एवं श्री बृजेन्‍द्र चौधरी विद्वान अधिवक्‍ता द्व्‍य को सुना।

निर्विवादित रूप से विपक्षी कम्‍पनी द्वारा परिवादीगण को आवंटित फ्लैट का सम्‍पूर्ण विक्रय मूल्‍यप्राप्‍त किया जा चुका है, वह भी जनवरी,2012 में एवं आवंटित फ्लैट का कब्‍जा 03 वर्ष की अवधि में दिया जाना था। यह भी तथ्‍य निर्विवादित रूप से उल्लिखित पाया गया कि विपक्षी कम्‍पनी द्वारा उपरोक्‍तस्‍कीम/फ्लैट के सम्‍बन्‍ध में कम्‍पलीशन सर्टिफिकेट सम्‍बन्धित विभाग से वर्ष 2019 में ही प्राप्‍त किया जा सका, परन्‍तु फिर भी आज दिनांक तक आवंटित फ्लैट का कब्‍जा परिवादीगण को प्राप्‍त नहीं कराया जा सका। पक्षकारों के अधिवक्‍तागण द्वारा जो तथ्‍य उल्लिखित किये गये, वे पूर्णत‍: विरोधाभाषी प्रतीत हो रहे हैं।

तदनुसार उपरोक्‍ततथ्‍यों को दृष्टिगत रखते हुए विपक्षी कम्‍पनी की ओर से उपस्थित विद्वान अधिवक्‍तागण की सहमति से यह न्‍यायालय प्रस्‍तुत परिवाद एवं परिवाद सं0-71/2022 को अन्तिम रूप से निर्णीत किये जाने हेतु वास्‍तविकताओं से अवगत होना आवश्‍यक समझती है, जिस हेतु यह न्‍यायालय श्री प्रतुल प्रताप सिंह, अधिवक्‍ता (मो0 नं0 9984008008) को एडवोकेट कमिशनर के रूप में नियुक्‍त करतीहै तथा सम्‍बन्धित फ्लैट संख्‍या-M-403, प्रोजेक्‍ट ''सेलिब्रिटी ग्रीन्‍स’’, स्थित अंसल ए0पी0आई0, सुशान्‍त गोल्‍फ सिटी, लखनऊ एवं फ्लैट संख्‍या-L 801, आठवां तल, टावर-L''सेलिब्रिटी ग्रीन’’, स्थित- सेक्‍टर-बी, पाकेट-1, ग्रुप हाउसिंग काम्‍पलेक्‍स, सुशान्‍त गोल्‍फ सिटी, लखनऊ का स्‍थल निरीक्षण एवं वास्‍तविक तथ्‍यों के परीक्षण हेतु दिनांक 13.11.2022 को पूर्वान्‍ह 11:00 बजे स्‍थल निरीक्षण हेतु आदेशित करती है।

इस न्‍यायालय द्वारा नियुक्‍त एडवोकेट कमिश्‍नर द्वारा स्‍थल निरीक्षण के समय रंगीन छायाचित्र भी फ्लैट एवं फ्लैट में आनेजाने एवं फ्लैट की आवश्‍यकताओं को दृष्टिगत रखते हुए भी प्रस्‍तुत किया जावेगा। साथ ही आवंटित फ्लैट के नजदीक रहने वाले अन्‍य निवासियों से भी वार्तालाप कर वास्‍तविक वस्‍तु स्थिति का उल्‍लेख अपनी आख्‍या/रिपोर्ट में दर्शाया जावे, जिससे कि प्रस्‍तुत परिवाद एवं परिवाद संख्‍या-71/2022 अगली निश्चित तिथि पर पक्षकारों के विद्वान अधिवक्‍तागण को एवं एडवोकेट कमिश्‍नर की रिपार्ट को आधार मानते हुए निर्णीत किया जा सके।

एडवोकेट कमिश्‍नर द्वारा रिपोर्ट की प्रतियॉं उभय पक्ष के विद्वान अधिवक्‍तागण को दिनांक 18.11.2022 तक प्राप्‍त करायी जावें, साथ ही रिपोर्ट इस न्‍यायालय के कार्यालय में दिनांक 18.11.2022 तक प्रस्‍तुत की जावे।

विपक्षी कम्‍पनी सर्वेश्री मैसर्स के0जी0 कांस्‍ट्रक्‍शंस द्वारा इस न्‍यायालय द्वारा नियुक्‍त एडवोकेट क‍मिश्‍नर को 20,000/-रू0 फीस के रूप में एवं 5,000/-रू0 खर्चे के रूप में देय होगा। परिवादीगण द्वारा भी एडवोकेट कमिश्‍नर को 5,000-5,000/रू0 प्रति परिवादी देय होगा। उपरोक्‍त धनराशि पक्षकारों द्वारा एडवोकेट कमिश्‍नर को हर दशा में  दिनांक 10.11.2022 तक प्राप्‍त करायी जावे।

तदनुसार प्रस्‍तुत परिवाद एवं परिवाद सं071/2022 को पुन: दिनांक 23.11.2022 को भोजनावकाश के पश्‍चात 02:00 बजे प्रथम वाद के रूप में सुनवाई हेतु सूचीबद्ध किया जावे।

कार्यालय को आदेशित किया जाता है कि इस आदेश को आयोग की वेबसाइट पर हर दशा में दिनांक 07.11.2022 तक अपलोड कर दिया जावे।“

In pursuance of the order dated 04-11-2022 the learned Advocate Commissioner appointed by this Court has submitted his report alongwith coloured pictures of the unit/flat in question which are enclosed as Exhibit CCR-1 to Exhibit CCR-6. For the ready reference this Court deem it appropriate to incorporate the Advocate Commissioner’s report:- 

    “To, The Hon’ble Commission and the other Hon’ble Members of the Bench.

    Subject : Advocate Commission Report in Complaint Case No. 191/2019 Subhash Chandra Singh versus Ansal Properties and Infrastructure Ltd. and others.

              As per the direction of this Hon’ble Commission dated 04-11-2022 in C/191/2019, I was directed to inspect Flat No. M-403 situated at Celebrity Greens, Ansal API, Sushant Golf City, Lucknow and to submit my commission report on the said flat which is subject matter in dispute in this complaint case before this Hon’ble Commission.

              As per the direction of this Hon’ble Commission I visited the Project on 18-11-2022 at about 11 am. The parties were present on site, from the side of complainant Mr. Yadavendra Pratap Singh (brother of the complainant) was present in person and K.G. Constructions was represented by their General Manager/Consultant (Construction) Mr. Akhil Tandon and other officers. I inspected the concerned flat in their presence and took photographs of the of the entire inspection of the flat.

              Both the lifts were found in a perfect working condition and there was CCTV security camera on every floor as well as a security guard at the entrance of Tower M.

              There were three flats on the fourth floor of Tower M. Upon entering the flat M-403, I noticed that the first room was being used as a store room for keeping construction related material.

              The first bathroom was very dirty had no fittings and even the flase ceiling was damaged and was not in order. The tile work in the bathroom was proper and neat. Photograph of the first bathroom is being annexed with this report as Exhibit CCR-1.

              The common area/drawing room was clean and the flooring and paint work looked satisfactory, but there was a key holder mounted on one of the walls and gave an impression that this particular flat was being used for keeping miscellaneous things by the Builder. Photograph of the common area/drawing room is being annexed with this report as Exhibit CCR-2.

              The kitchen looked in a better condition and the work done with the flooring and kitchen cabinets was satisfactory although it was devoid of iany fittings as in other areas of the flat. Photograph of the kitchen is being annexed with this report as Exhibit CCR-3.

              The other two bathrooms were in a pathetic condition and looked very shabby. The western commode was uprooted in one of the bathrooms and both the bathroom had no bath fittings in them. Photographs of the other two bathrooms are being collectively annexed with this report as Exhibit CCR-4.

              The other room in the flat looked in a good condition but there was no electrical fitting in any of the rooms or bathrooms.

              After the inspection the representative of the complainant informed that there has been no written offer of possession from the side of the builder. The builder has only verbally offered to give possession.

The representative of the builder informed that a CBI enquiry under section 13(2) r/w 13(1) (e) of Prevention of Corruption Act, 1988 in Case No. RC Jai 2012 A 0016 by CBI Jaipur Branch. He further informed that in the year 2013, a team of CBI officials visited the office of the builder for obtaining documents germane to the enquiry. He also informed that the complainant was also intimated in the year 2016 and 2017 to clear his dues and to take possession of the flat but the complainant did not respond to the same.

         The representative of the builder also informed that the registry of flats in the concerned tower are being executed since the year 2015 and after obtaining NOCs for Lift, Fire and Vidyut Suraksha the builder has obtained Completion Certificate from Lucknow Development Authority in the year 2019. He further informed that the flat can be made in habitable condition in a period of two weeks if the complainant is ready to take possession of the flat.

         After inspection of the flat I tried to contact the other occupants on the same floor, Flat M-401 was found to be locked and then I approached flat M-402 and rang the bell. One Mr. Dharampal came out and told that he is the tenant and gave me the name and phone number of the owner Mr. Shiv Murut Sahu (9305823552). I gave a call to Mr. Sahu who informed that he had booked his flat in the year 2011 and the paid the entire amount through bank loan (HDFC bank). He also informed that he got his registry done in the year 2015 and has not come across any demands from builder since then.

        The parking area was in the basement which is accessible through the lifts and was in a decent condition. Photograph of the parking area is ibeing annexed with this report as Exhibit CCR-5.

            It was also informed that tower M has an occupancy of about 60%. Some other photographs of Tower M are being collectively annexed with this report as Exhibit CCR-6.

         Conclusion : In pursuance of the order dated 04-11-2022 passed by this Hon’ble Commission, I am furnishing my report along with the supporting photographs taken at the site of inspection for kind perusal by this Hon’ble Commission.

         Learned Counsel for the opposite parties Sri Rohit Chandra has submitted that the Company has received a confidential letter dated 30-08-2013 with regard of certain investigation related to the complainant.

         Learned Counsel for the complainant has placed a copy of the order dated 14-01-2019 with regard to case in which the closure report has been submitted by the C.B.I. before the Court concerned long back.

         Learned Counsel for the complainant has informed the Court that the departmental enquiry initiated against the complainant has been finalized by the department in the year 2017 and there is no enquiry pending against the complainant and that the complainant is presently posted as Assistant General Manager, BSNL, Ghaziabad. Even otherwise the said investigation has nothing to do with the present proceedings.

         The Counsel for the opposite party has taken the shelter of the above mentioned departmental enquiry which has no concern whatsoever with the present complaint case.

Admittedly the flat in question allotted to the complainant is not in a position where the complainant can reside or can take the possession of the same in the present conditions.

         The Counsel for the opposite party has assured this Court that whatever defect and essential requirement pointed out by the complainant will be fulfilled and completed to the satisfaction of the complainant by the opposite party No.02 within a period of two weeks from today.

    The complainant will visit the site/flat tomorrow at 12.00 P.M. when the concerned official of the opposite party No.02 will be present to whom the complainant will apprise all requisite in writing which will be completed and finalized by the opposite party No.02 on or before 10th December, 2022.

The official of the opposite party will also provide the details of the figure of the E-stamp which is to be purchased by the complainant and before 10th December, 2022 the registration proceedings of the flat will be completed by the opposite party and a photostat copy of the registration deed will be produced by the learned Counsel represents the opposite party No.02.

         The Counsel for the complainant in the meantime will prepare the detailed chart with regard to compliance of the contents of the letter issued by the opposite party No.02 dated 30-12-2012 clearly indicating therein the amount of penalty as admittedly admitted and indicated by the opposite party in the said letter. A copy of the said chart will be handed over by the Counsel for the complainant to Sri Rohit Chandra, Counsel for the opposite party No.02 by 12-12-2022.

         Sri Rohit Chandra, Counsel for the opposite party No.02 will provide the said chart to the concerned official of the Company/Director of the Company who will scrutinize the same and will pay the amount due to the complainant on the next date fixed which this Court fixed as 20-12-2022 by way of Demand Draft.

         List this case as first case on the next date fixed i.e. on 20-12-2022.  

विपक्षी संख्‍या-2 मैसर्स के०जी० कंस्‍ट्रक्‍शन्‍स की ओर से पूर्व में विद्वान अधिवक्‍ता श्री रोहित चन्‍द्रा उपस्थित हो रहे थे जिनके स्‍थान पर आज विपक्षी संख्‍या-2 की ओर से विद्वान अधिवक्‍ता श्री संजीव बहादुर उपस्थित हुए जिनके द्वारा पूर्व अधिवक्‍ता श्री रोहित चन्‍द्रा से एन०ओ०सी० प्राप्‍त की गयी तथा वकालतनामा कार्यालय में आज प्रस्‍तुत किया गया जिनके द्वारा इस न्‍यायालय के अवलोकन हेतु कुछ छायाचित्र प्रस्‍तुत किये गये तथा यह कथन किया गया कि अपेक्षित कमियों को विपक्षी संख्‍या-2 द्वारा आवंटित फ्लैट के सम्‍बन्‍ध में पूर्ण किया गया है जबकि परिवादी श्री सुभाष चन्‍द्र सिंह स्‍वयं उपस्थित हुए जिनके द्वारा अवगत कराया गया कि उनके द्वारा आवंटित फ्लैट का निरीक्षण दिनांक 19-12-2022 को स्‍वयं किया गया तथा अपेक्षित कमियों को उल्लिखित करते हुए एक प्रार्थना पत्र प्रस्‍तुत किया गया जिसकी प्रति विपक्षी संख्‍या-2 की ओर से उपस्थित विद्वान अधिवक्‍ता श्री संजीव बहादुर को प्राप्‍त करायी गयी। विपक्षी के विद्वान अधिवक्‍ता द्वारा यह कथन किया गया कि उल्लिखित कमियों को यथाशीघ्र 01 सप्‍ताह की अवधि में दूर किया जावेगा तथा परिवादी द्वारा दिनांक    27-12-2022 को फ्लैट का स्‍थल निरीक्षण स्‍वयं पूर्वाहन 11.00 बजे किया जावेगा। स्‍थल निरीक्षण के समय विपक्षी संख्‍या-2 के अधिकृत प्रतिनिधि स्‍वयं उपस्थित मिलेंगे जिनके द्वारा आज प्रस्‍तुत प्रार्थना पत्र में उल्लिखित कमियों को दूर किये जाने के सम्‍बन्‍ध में तथ्‍यों को परिवादी के

दृष्टिकोण से पूर्ण किया जाना बताया जाएगा। उपरोक्‍त विपक्षी संख्‍या-2 के अधिकृत प्रतिनिधि द्वारा उपरोक्‍त फ्लैट का कब्‍जा परिवादी को प्राप्‍त कराते हुए पंजीयन की धनराशि के सम्‍बन्‍ध में लिखित में जानकारी प्राप्‍त करायी जावेगी जिस सम्‍बन्‍ध में ई-स्‍टाम्‍प परिवादी द्वारा दो कार्यदिवस में विपक्षी को छायाप्रति हस्‍तांतरित की जावेगी। विपक्षी द्वारा उपरोक्‍त छायाप्रति में इसका उल्‍लेख करते हुए व्‍हाट्सअप के माध्‍यम से परिवादी को उत्‍तर प्राप्‍त कराया जावेगा तदनुसार विपक्षी द्वारा परिवादी के पक्ष में आवंटित फ्लैट के पंजीकरण की प्रक्रिया में विपक्षी संख्‍या-1 अंसल प्रापर्टीज द्वारा इस आदेश में उल्लिखित समस्‍त तथ्‍यों को दृष्टिगत रखते हुए यथासम्‍भव आवश्‍यक सहयोग प्रदान किया जावेगा। सर्व श्री अंसल प्रापर्टीज एण्‍ड इंफ्रास्‍ट्रक्‍चर्स लि0 की ओर से विद्वान अधिवक्‍ता श्री मानवेन्‍द्र प्रताप सिंह उपस्थित हुए जिनको इस आदेश की प्रति विपक्षी संख्‍या-2 द्वारा 3 कार्यदिवस में प्राप्‍त करायी जावेगी।

प्रस्‍तुत वाद को पुन: सुनवाई हेतु दिनांक- 25-01-2023 को सूचीबद्ध किया जावे।''

 विपक्षी सं0-2 के विद्वान अधिवक्‍ता श्री संजीव बहादुर श्रीवास्‍तव द्वारा इस तथ्‍य से अवगत कराया गया कि परिवादी को इस न्‍यायालय के उपरोक्‍त आदेश के अनुपालन में स्‍थल निरीक्षण कराकर परिवादी को फ्लैट सं0 एम-403 ‘CELEBRITY GREENS’ सैक्‍टर-3 टावर-एम अंसल ए.पी.आई. सुशांत गोल्‍फ सिटी, लखनऊ का वास्‍तविक कब्‍जा प्राप्‍त कराया जा चुका है एवं परिवादी द्वारा आदेश के अनुपालन में ई-स्‍टाम्‍प क्रय कर उसकी छायाप्रति विपक्षी को प्राप्‍त करायी गई परन्‍तु विपक्षी कम्‍पनी द्वारा उपरोक्‍त छायाप्रति में जो आवश्‍यक उल्‍लेख अर्थात सेल्‍स Consideration की धनराशि  रू0 32,65,903.00 (बत्‍तीस लाख पैंसठ हजार नौ सौ तीन रू0) उल्लिखित की गई है वह गलत रूप से उल्लिखित की गई है जबकि वास्‍तविक रूप से परिवादी द्वारा उपरोक्‍त फ्लैट हेतु कुल धनराशि रू0 33,50,000.00 (तैंतीस लाख पचास हजार रू0) विपक्षी को प्राप्‍त करायी गयी है तद्नुसार आदेशित किया जाता है कि विपक्षी सेल डीड का रजिस्‍ट्रेशन कराते है परिवादी द्वारा

प्राप्‍त करायी गई सम्‍पूर्ण धनराशि अर्थात रू0 33,50,000.00 (तैंतीस लाख पचास हजार रू0) का उल्‍लेख ई-स्‍टाम्‍प में एक सप्‍ताह की अवधि में सुनिश्चित कर पंजीकरण की सम्‍पूर्ण प्रक्रिया परिवादी के पक्ष में सुनिश्चित करे। तद्नुसार प्रस्‍तुत परिवाद अंतिम रूप से निस्‍तारित किया जाता है।

अंतरिम आदेश यदि कोई पारित हो, तो उसे समाप्‍त किया जाता है।

यहॉ यह स्‍पष्‍ट किया जाता है कि यदि इस आदेश का अनुपालन विपक्षी कम्‍पनी द्वारा सुनिश्चित नहीं किया जावेगा तब विपक्षी के विरूद्ध हर्जाना रू0 1,00,000.00 योजित किया जावेगा।
