Amit Mehrotra V/s M/s Ansal Properties and Infrastructure Limited and another

          25-04-2022

Heard Sri Dilip Singh, learned Counsel for the complainant and Sri Manvendra Pratap Singh, learned Counsel for the opposite parties.

After hearing learned Counsel for the respective parties at some length and during the course of hearing the chart with regard to deposit of the money by the complainant and the rate of interest calculated both @ 10% and by another chart interest calculated @ 15% has been filed by Sri Manvendra Pratap Singh. We find that an affidavit in support of the calculation chart on behalf of the complainant dated 22-04-2022 has been filed by the learned Counsel for the complainant. We find that there is some calculation difference in the chart filed by the Counsel for the complainant and the chart filed by the Counsel for the opposite parties so far as the calculation of interest @ 15% is concerned.

After hearing learned Counsel for the respective parties and seeing the peculiar circumstances of the instant complaint, we find it appropriate to direct the opposite parties to pay the entire principal amount alongwith interest @ 12% per annum from the date of deposit of the amount within a period of one month from today as agreed by the learned Counsel for the respective parties.

We deem it appropriate to dispose of the instant complaint by directing the opposite parties to comply with the order as indicated hereinabove.

With the above direction the complaint is disposed of.

Let copy of this order be made available to the parties as per rules.

The Stenographer is requested to upload this order on the website of this Commission at the earliest.
