                                                       ORDER              

The instant misc. application has been filed by the complainant Sri Banarasi Singh, who himself has argued the case before this Court.

The submission of Sri Banarasi Singh is that a Complaint Case No. 490/2022 has been filed before the learned District Consumer Commission-I, Lucknow on 01-08-2022. The learned District Consumer Commission thereafter has passed an order and the date has been fixed being 02-09-2022, 28-11-2022, thereafter 29-03-2023 for hearing and on the next date fixed i.e. on 20-05-2023 the written statement was directed to be filed by the opposite party fixing 16-08-2023.

The submission of Sri Banarasi Singh is that till date no written statement has been filed by the opposite party and the period for filing the written statement has already been expired, therefore, the learned District Consumer Commission has not justified in granting the time to the other side to file the written statement.

Without going into the merit of the case and the controversy related to the complaint, the instant Misc. Case is finally disposed of by this Court directing the District Consumer Commission-I, Lucknow to consider the submission of the complainant regarding the limitation of filing of the written statement by the opposite party and decide the same on the next date fixed and thereafter proceed in the matter in accordance with law by deciding the complaint on merits.

            Accordingly the misc. case is disposed of.

            Let copy of this order be made available to the parties as per rules.

            The Stenographer is requested to upload this order on the website of this               Commission today itself.
