Both parties are present. Complainant has received entire amount of Rs. 29 Lakhs from the O.P. developer as per order. Possession of the flat is already taken from the O.P. developer by the complainant. On measurement 275 Sq. Ft. area is found short so O.P. agrees to pay rs. 90000/- to the complainant  who agrees to accept it.

On 17/09/2014 actual possession of the flat of a 1513 sq. ft. is taken by the complainant and so since 17/09/2014 complainant shall have to pay maintenance and other charges of the said housing complex to the developer Sriniket Residence Flat Owners Association but no amount can be charged by developer and / or said Flat Owners Association from the complainant by any means.

Accordingly O.P. developer shall pay the said Rs. 90000/- to the complainant by 22/01/2015 in default order can be executed.

Thus the present complaint is disposed of on full consent of both parties.

So, complainants entire claim is satisfied and op developer has his power to execute .

Deed of sale in favour of all intended purchasers on the basis of this power of attorney. Finally disposed.
