The Complainant files hazira through Advocate.

No step is taken by the O.P.

The case is fixed for argument.

After hearing argument from the Complainant the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he purchased a motor bike Registration No. being WB 68 AD2802 from O.P. with down payment of Rs.12,000/- under three different money receipts and taking loan from the Bajaj Finance Ltd under Agreement No.L2 WBNK 0844880. Though the loan amount has been fully paid but the O.P./Dealer has not parted with the relevant documents of the motor bike i.e. R.C. Book, Insurance Policy, Number Plate, Tax Token and Pollution Certificate. The Complainant has therefore approached this Commission for appropriate relief.

The O.P. contested the case by filing a written statement stating therein about non-receipt of down payment and other fees & charges and as such he has prayed for dismissal of this case.

Perused the Complainant’s case  and all the materials on record.

Money receipts on record shows the proof of down payment of Rs.12,000/- in favour of the O.P. and  the loan A/c  statement which is also on record shows that the loan has been fully cleared and the Finance Co. is required to issue N.O.C. accordingly.

O.P. being the Dealer of the motor bike has the bounden duty to hand over all the relevant papers and documents of the motor bike i.e. R.C. Book, Insurance Policy, Number Plate, Tax Token and Pollution Certificate to the Complainant on payment of requisite fees and charges  for all those papers and documents and on production of N.O.C. to be obtained from Bajaj Finance Co.

Accordingly it is ordererd…..

that the case is disposed of on contest by directing the O.P. to hand over all the relevant papers and documents of the motor bike mentioned above to the Complainant on payment of requisite fees and charges for the same and on production of N.O.C. to be obtained from Bajaj Financer Co.within a month from this date in default law will take its own course.

Both parties be supplied copy of this Judgement free of cost.
