ORDER

1.   At this stage, the matter between the parties has been settled. Vide his separate statement, Sh.Sanjeev Sharma, Counsel for OP No.1 & 3 has stated that the matter has been settled between the parties and as per settlement, OP No.1 will hand over the physical possession, complete in all respects, of the flat in question to the complainants subject to complainants making the remaining payment of Rs.17,00,000/- including other charges/taxes etc. to OP No.1 within 60 days from today i.e. 15.05.2024. It has been further stated by counsel for OP No.1 & 3 that the physical possession will be handed over to the complainants within a week after receiving the amount of Rs.17,00,000/- from the complainants. It has been further stated by counsel for OP No.1 & 3 that the bank loan as per tripartite agreement shall be paid by complainants and OP No.1 & 3 have nothing to do with the same. Vide his separate statement, Sh.Surinder Singh Slathia, Complainant No.1 for himself and on behalf of Complainant No.2 Mrs.Sushma Slathia i.e. his wife, has admitted the aforesaid statement of counsel for OP No.1 & 3 and prayed that the complaint be disposed of in terms of aforesaid settlement. It has been further stated by complainant No.1 that he does not press this complaint against rest of the OPs. Vide her separate statement, Ms.Savita Bhardwaj, Counsel for Complainants has endorsed the aforesaid statements of counsel for OP No.1 & 3 and complainant No.1, on behalf of complainant No.2. 

2.   In view of the statements of the counsel for OP No.1 & 3 and complainants and in terms of the settlement, the complaint stands disposed of by passing the following order:-

  1. The complainants are directed to make the remaining payment of Rs.17,00,000/- including other charges/taxes etc. to OP No.1 within 60 days from today i.e. 15.05.2024.
  2. OP No.1 will hand over the physical possession, complete in all respects, of the flat in question to the complainants within a week after receiving the aforesaid amount of Rs.17,00,000/- from the complainants.
  3. The bank loan as per tripartite agreement shall be paid by complainants and OP No.1 & 3 have nothing to do with the same.

 

3.   The present consumer complaint against OP No.2 to 8 stands dismissed being not pressed by complainants. The miscellaneous application No.104 of 2022 filed by complainants also stands disposed off. 

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
