Hyderabad, the complainant
therefore he approachedRemedyHospital, which is a Super Speciality hospital for further complete examination where he was thoroughly examined and declared that he was not suffering from AIDS.
RemedyHospital
29-8-2002
28-8-2002in which it is stated that:
HIV I & II: POSITIVE
Ex.A4 is the Remedy Super Speciality hospital report dated29-8-2002
H.I.V. I & II Antibodies(IgG & IgM): Non Reactive
Negative result does not exclude the possibility of exposure to or infection with HIV I or II.
The serology report Ex.A8 of HBs Ag is also negative. 4-9-2002 Ex.A15 is the discharge bill issued by Remedy hospital on9-9-2002, date of admission being29-8-2002
The main point for consideration in this case is whether the respondent/opposite party had given a wrong test report to the complainant thereby necessitating further tests and mental agony to the complainant?
Ex.A1 is not in dispute. Osmania GeneralHospital
Ex.A1 clearly states that blood for HIV I & II is positive. 29-8-2002
