On perusal of file, it has come into notice of the Commission that complainant is not submitting copy of complaint etc. for the last many dates for issuance of notice to Ops and today, present complaint is again fixed for submitting copy of complaint etc. for issuance of notice to OPs No.1 & 2 with the rider that ‘otherwise the complaint shall be dismissed for want of non prosecution’ but today again neither the complainant appeared before the Commission nor any Advocate/authorised representative appeared on his behalf. From the perusal of case file, it reveals that on the previous date of hearing i.e. 17.10.2022, neither complainant nor his counsel or representative was present and thus, in the interest of justice, present complaint was adjourned for the said purpose for today but today also, neither the complainant nor any Advocate/authorised representative appeared on behalf of complainant before the Commission till 12:30 P.M. In the interest of justice, case be again called after lunch break.

Case called at 03.50 P.M., but this time also, neither complainant nor any representative on his behalf appeared before the Commission wherefrom it is presumed that complainant is not interested to pursue the present complaint. It is 3.55 P.M. Further wait is not justified. As such, we have no option except to dismiss the present complaint. Hence, the present complaint is hereby dismissed in default for want of non prosecution. Copy of this order be supplied to the parties to complaint free of costs. File be consigned to record room, after due compliance.
