  2. M/s JD Universal Infra Limited, Sector-35, basement community centre, Vasant Vihar, Delhi-110057, through its Authorized Signatsory.

Complaint under Section 35 of Consumer Protection Act, 2019.

Present:  Sh. Anuj Khurana, complainant in person alongwith Sh. P.K.Bhandari, Advocate.

Sh. Sandeep Sharma, Authorized Representative alongwith Sh.   Pawan Sharma, counsel for the OPs.

                            

 

                   Today the case is fixed for arguments.

                   At this stage, Shri Sandeep Sharma, Authorized Representative of the OPs has suffered a separate statement that the matter has been compromised with the complainant and as per the compromise, he has received the remaining basic balance of Rs.7,71,337/- by way of two cheques i.e. cheque bearing no.000055 dated 31.10.2023 amounting to the Rs.4,00,000/- and cheque bearing no.000056 dated 31.10.2023 amounting to Rs.3,71,337/-. The company has applied for occupation certificate to the concerned department and on receipt of the occupation certificate, the company will hand over physical possession of the flat no.A6/208, on receipt of remaining charges as per the flat buyer agreement from the complainant. The occupation certificate will be obtained approximately within six months from today.

                   On the other hand, complainant suffered his separate statement to the effect that the matter has been compromised with the OPs and as per the compromise, he has handed over two cheques bearing no.000055 dated 31.10.2023, drawn on HDFC Bank, amounting to Rs.4,00,000/- and cheque bearing no.000056 dated 31.10.2023, drawn on HDFC Bank, amounting to Rs.3,71,337/- (he has placed on record copies of cheques). Keeping in view of the statement made by the authorized representative for the OPs, he withdraws the present complaint. In case, the OPs will not abide of the terms of the compromise, he reserves the right to file fresh complaint against the OPs.

                 In view of the above statements, the present complaint is dismissed as withdrawn. Both parties will bound their statements. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
