AWARD

1]        Vide his separate statement recorded on 12.8.2024, the ld.Counsel for the OPs got recorded the following statement:-

          As per amicable settlement with the complainant, today a cheque bearing No.168741, dated 20.8.2024 favouring complainant of Rs.2,87,300/- has been handed over to the ld.Counsel for the complainant and as per mutual settlement, an amount of Rs.20,000/- shall be paid as litigation expenses for both the complaints i.e. present consumer complaint as well as another criminal complaint filed by the complainant under Section 138 of NI Act before the court of ld.JMIC, Chandigarh.  On the clearance of aforesaid cheque and on payment of Rs.20,000/- towards litigation charges, the complainant will withdraw the present consumer complaint as well as criminal complaint filed by the complainant against OP under Section 138 of NI Act before the court of ld.JMIC, Chandigarh.

 

2]        The ld.Counsel for the complainant vide separate statement recorded on 12.8.2024 as well as on 22.8.2024, agreed to the aforesaid statement of ld.Counsel for the OPs and admitted to have received the settled amount and as such withdrew the present complaint, subject to clearance of cheque.

 

3]        In view of the statements of the counsels for the parties and in terms of the settlement, the complaint stands disposed of by passing the following award:-

  1. After clearance of cheques, so given by the OPs to the complainant, against receipt, in the present consumer complaint, the complainant will withdraw criminal complaint filed by her against the OPs under Section 138 of NI Act before the Court of ld.JMIC, Chandigarh
  2. In case the cheques so given by the OPs to the complainant against receipt in the present consumer complaint are not cleared, then the OPs shall be liable to pay the cheque amount alongwith interest @ 9% p.a. from the date of filing of present consumer complaint till the payment is made and the complainant shall be at liberty not to withdraw the criminal case filed by her against the OPs, as mentioned statement, and further she shall be at liberty to avail legal remedy, as per law.

3.   The award is accordingly passed.

5.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
