1.               The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has  prayed for direction upon the o.p. for payment of Rs. 10,61,802/- being the value of the articles lying in the go-down of the o.p. and to pay compensation of  Rs. 6 lakhs for causing mental tension and harassment together with transportation charge of Rs. 50,000/- and Rs. 35,000/- for detaining the articles for 16 days. As the o.p. company in spite of the agreement of sending the P.P. Woven Sacks to the Government of Punjab for packaging food grains did not comply with the same and confused the complainant over the progress of delivery. The complainant further contended that the o.ps. provided five trucks on 24-04-2013 to the complainant for loading and sending the materials to specified destination. Accordingly 100 bales were loaded on the vehicles and released on 24-04-2013 vide respective invoices with transporter C.N.  Nos. 147, 148, 161 & 162 respectively. But ultimately the o.p. did not comply as per agreement. 

 

2.               The o.p. in the written version challenged the maintainability of the complaint and contended interalia that the allegations made in the complaint are absolutely  baseless as the consignment reached its destination in due time.

 

 

3.        Upon pleadings only one point is framed for consideration :

 

            Whether the complaint is maintainable before this Forum  ?

 

 

DECISION  WITH   REASONS      :

 

 

4.               On scrutiny of the complaint it appears that the complaint is hit by the provision of Section 2(1)(d).  The complainant being a concern of packaging styled as Arnapurna Packaging Industries Pvt. Ltd. and having  nearly 60 employees working under the complainant concern, cannot be considered as consumer as it is hit by commercial purpose. During argument to a question of the Bench ld. Lawyer for the complainant admitted that nearly 60 employees worked under Arnapurna Packaging Industries Pvt. Ltd. Furthermore, it is evident from the statements of the complaint and BNA that five lorries were used for transportation. A simple consumer cannot make such consignment in five lorries unless the concern deals in commercial purpose.   

 

           In the result, we are of the view that the complaint is not maintainable and require to be dismissed.

      That the C. C. Case No. 20 of 2014 ( HDF  20 of 2014 )  be  and the same is dismissed on contest but without costs not being maintainable before this  Forum.

 

      Supply the copies of the order to the parties, as per rule.
