O R D E R

1.           Brief facts of the present complaint are that the complainant purchased one chest Freezer/Deep Freezer, Model No. GT400 CHP under Amul Scheme for Ice  Cream use, vide Invoice NO.1135 dated 5-5-2014 in a sum of Rs.28,847/- from OP No.1 having  a  warranty of 1 year+ 4 years @ 5 years from the date of purchase. After purchasing , the  said  freezer  was  not  working  properly  and the complainant made the complaint to OP No.1 and thereafter said freezer  was  repaired  thrice  by OP No.1 including the last repair on  24-4-2015 but  the  same  remained  functional  till  the morning of 26-4-2015 and  thereafter  the  complainant sent e-mails on 27-4-2015, 29-4-2015, 30-4-2015 with regard to non-functioning of the freezer to OPs which they failed to respond  and at last, the complainant got served legal notice dated 1-5-2015 upon the OPs through his counsel but of no use. As such, having no alternative, complainant preferred the present complaint seeking relief as mentioned in the prayer para.

 

2.          Notice of complaint  was  duly served  upon the OPs but both the  OPs  failed  to  appear before the forum despite service  through regd. Post and as such,  they  were  proceeded against ex-parte vide order dated 19-08-2015.  

 

3.           To prove his version, complainant tendered his affidavit as Annexure C -X alongwith documents as Annexures C-1  to C-18  and closed his evidence.

4.           After perusal of documents Annexure C-1 to Annexure C-18 placed on record by complainant, it is nowhere proved that the deep-freezer in question was having any manufacturing defect/ inherent defect as alleged in the complaint since no any document/ job card or even affidavit of the mechanic has been produced  by the complainant to prove his contention. Further, service center of the freezer where the complainant got checked the freezer in question has not been impleaded as a party to the complaint though the same was necessary party  to prove the contention of the complainant. As such, the complainant has miserably failed to prove his case and thus we have no option except to dismiss the present complaint. As such, the present complaint is hereby dismissed with no order as to costs. A copy of this order be sent to the parties concerned free of costs. File be consigned to the record room after due compliance.
