ORDER

 

 

  1. The present complaint has been preferred by Mrs. Bimla Dalmia & Another seeking refund of amount of Rs.38,74,959/- paid by the them to the opposite parties along with interest besides compensation of Rs.5,00,000/- and litigation expenses of Rs.70,000/-.
  2. Upon notice, the opposite parties have put in appearance and filed their written version was followed by the parties recording their respective evidence.
  3. Counsel appearing for the complainants states that during the pendency of the complaint, the parties have amicably settled the matter and accordingly, the complainants want to withdraw the complaint. He has also place on record two separate affidavits of Mrs. Bimla Dalmia and Mrs. GeetiBhojnagarwala, which are taken on record.
  4. Counsel appearing for the opposite parties states that he has no objection, if the complainants are allowed to withdraw the complaint.
  5. In view of the above, the complaint is disposed of as having been withdrawn in view of the compromise arrived at between the parties.
  6. Application(s) pending, if any, stand disposed of in terms of the aforesaid order.
  7. A copy of this order be provided to all the parties free of cost as mandated by the law. The order be uploaded forthwith on the website of the Commission for the perusal of the parties.
  8. File be consigned to record room along with a copy of this order.
