The appellant is the unsuccessful complainant.

The point that arises for consideration is whether the order of the District Forum is vitiated by any mis-appreciation of fact or law in that regard?
It is an undisputed fact that on the notification, dt.20-8-2005, issued by the Housing Board for allotment of a duplex house at Rs.16,16,000/-,
When the Housing Board has put the said house for re-auction by its notification Ex.B3, dated 07-10-2006, the very complainant participated in the auction, bid at Rs.12,25,000/- vide Ex.B4 dated 07-11-2006.
It may be stated herein that at no point of time, the complainant has questioned Ex.A4 letter, wherein his agreement was cancelled. When the very agreement provides such a course and the Board re-coursing to the said clause cancelled the allotment, if really, the complainant was of the opinion that it was unjust, he ought to have questioned.
In the result this appeal fails and is accordingly dismissed, however no
