Today is fixed for hearing on the point as to the admissibility of the complaint.

But the Ld. Advocate appearing for the complainant submits that he wants to withdraw the case with liberty to sue afresh.

Accordingly the case be and the same is dismissed as withdrawn: but without cost.

The complainant would however be at liberty to file a fresh complaint on the self-same cause of action.

Let a plain copy be given to the parties free of cost as per CPR.
