This case record is placed before the Ld. Judges, Madhyastata Lok-Adalat on this day which is held at the court room at D.C.D.R.C., Howrah. Both parties are found present. They are also with their Ld. Lawyers.

Heard Ld. Advocates of both sides. Considered submission.

In course of hearing it is revealed that the flat (owner’s allocation) which has been handed over to the complainant by the O.ps. is measuring less than the agreed measurement as a result of which the O.ps./promoter/developer is refunding Rs.3,00,000/- to the complainant. Complainant admitted that he received the Bank draft being No.672713 dated 04/08/2023 of Indian Bank, Howrah branch. One money receipt has been filed by the complainant showing the payment of Rs.3,00,000/-

As per submission of the Ld. Advocate of the both sides dispute involved in the case have been amicably settled and for that reason the complainant is going to withdraw this case. In this regard one petition supported by affidavit has been filed before this Ld. Adalat.

As the dispute involved in the case have been amicably settled in between the parties and the complainant is voluntarily withdrawing this case, Ld. Judges of this Lok-Adalat have no reason to stand on the way in the amicable settlement.

In the result,

it is accordingly,

o r d e r e d

that this complaint case being no.263/2021 be and the same is settled in between the parties. Let the withdraw petition which has been filed by the complainant and the money receipt which is filed by the complainant be made a part of this order.

As the complainant is withdrawing this case voluntarily let the case be disposed of as it is withdrawn.

Let a free copy of this order be handed over to the parties of this case.

Let this order be uploaded in the official website as soon as possible.

In the light of the observation made above the complaint case is disposed off.
