ORDER

Heard the counsel for the complainant regarding admission of the complaint. At this juncture we would like to refer to the order passed by this Forum in CC 36/08 holding that the complainant had raised a dispute before the Assistant Registrar of the Co-operative Society under the provisions of Societies Act and Assistant Registrar passed an order granting substantive relief directing the opposite party to return the documents within 15 days. The learned counsel today brought to our notice that the opposite party failed to comply the order of the Assistant Registrar and the Assistant Registrar has directed complainant to approach the appropriate court for relief advocate submitted that the complainant has remedy and right to file the execution case before the competent civil court for getting the order of the Assistant Registrar of Co-operative Society executed. If there is such provision for getting that order executed in civil court, the complainant can do so without resorting to file this complaint. With this complaint for the same relief is not maintainable as the substantive relief is already granted to the complainant. Thus the complaint is dismissed at this stage of admission.
