Both parties are absent. The notice with remarks of the peon is filed by the office. Perused the same. It is mentioned by the peon that O.p No.2 is not present at present and one Bajaj Motors is running in the site. The Regd.notice sent to O.p No.1 was returned back before with remarks that he is absent for longtime. The Complainant has not filed any correct address of the Opp.parties. This case is lingering since September 2016. The Complainant is also not interested to proceed with the case as he is not present in the last three dates. Hence the Complaint is dismissed for non prosecution. However the Complaint is at liberty to file fresh case on new cause of action.
