This is an appeal preferred by the opposite party against the order of the District Consumer Forum-III,

The case of the complainant in brief is that she purchased a Pedestal Surgical Special Cycle on 19.05.2007 as per doctor’s advise and paid an amount of Rs.11,500/-.   Hyderabad 

The opposite party filed written version stating that the cycle that was provided by them has no manufacturing defect and they had in fact sent a mechanic to get the same repaired, and there is no evidence filed by the complainant to show that the exercise cycle was not functioning properly. 

The District Forum based on the evidence adduced and the pleadings put forth by both parties directed the opposite party to pay Rs.11,500/- with interest at 9% per annum together with compensation of Rs.5,000/- and costs of Rs.500/-.

  Aggrieved by the said order, the opposite party preferred this appeal.               

In the result, the appeal is allowed in part and the order of the District Forum is modified directing the appellant/opposite party to pay the amount to the respondent/complainant on 10.12.2008 and the respondent/complainant shall return the cycle to the appellant on the same day.
