The complainant in proof of her      

           she was eligible for pension under EPS scheme, and since she returned the amount settled by the appellant there is no bar for sanction of monthly pension to her.

         Undoubtedly, Employees’ Pension Schemes 1997 as well as 1995 provided that a person, who was already a member of the scheme of 1971 and who was under employment as on 16.11.1995 would automatically become a member of   

It is an undisputed fact that the complainant worked in the 2^nd                     

securing the well being of the employees and the Court will not adopt a narrow interpretation which will have the effect of defeating the very object and purpose of the Act.
