State Commission has set aside the order passed by the District Forum and allowed the appeal without issuing Notice/hearing the petitioner.  It is cardinal principle of law that nobody can be condemned unheard.  Since the order passed by the State Commission is in violation of principles of natural justice, the same cannot be sustained.  Accordingly, the order under revision is set aside and the case is remitted back to the State Commission to decide it afresh after affording due opportunity of hearing to both the parties.

          Parties, through their counsel, are directed to appear before the State Commission on 12.1.2011.

          Since it is a very old case, we would request the State Commission to dispose of the appeal expeditiously and preferably within 4 months from the date of first appearance of the parties.
