By way of present revision petition prayer is made for recalling of the order dated 26.10.2018 passed by the District Forum (South West) in CC No.267/2018 by which the petitioner herein i.e. OP No.1 before District Forum has been proceeded ex-parte.
Counsel for petitioner/OP states that written statement is ready and next date before the District Forum is 18.07.2019 and shall file the same before the District Forum.
After some arguments, counsel for respondent No.1/complainant states that respondent No.1/complainant has no objection if subject to payment of costs, impugned order is set aside and petitioner/OP No.1 is permitted to file written statement before the District Forum.
Accordingly, with the consent of respondent No.1/complainant I accept this petition, set aside order dated 26.10.2018 by which the petitioner/OP No.1 has been proceeded ex-parte and allow the petitioner/OP No.1 to file its written statement before the District Forum, subject to payment of costs of Rs.10,000/- to respondent No.1/complainant.
Let parties appear before the District Forum on 18.07.2019. On the said date petitioner/OP shall pay costs to respondent No.1/complainant and shall file written statement before the District Forum. Thereafter, District Forum shall proceed in the matter in accordance with law.
Revision petition stands disposed of accordingly.
A copy of this order be sent to the parties free of costs as per rule and also to the concerned District Forum. Thereafter, the file be consigned to Record Room.
