None has appeared on behalf of any of the party.

On the previous date, i.e. 08.02.2023, the revisionists have submitted an application stating that the revisionists have filed the instant revision primarily against the order dated 25.01.2017, wherein it declined to stay proceedings till disposal of Civil Suit No. 347 of 2013, but the said suit has been decided by the learned Civil Court on dated 31.10.2022. Hence, in view of the above judgment, the instant revision has become infructous.

The above application is duly signed by the revisionists, whose signature is identified by the counsel for revisionists.

On the earlier date, i.e. 08.02.2023, the revisionists was directed to submit the copy of the judgment dated 31.10.2022 in Civil Suit No. 347 of 2013, but today same has not been submitted. 

As the revisionists themselves have alleged that the Civil Suit No. 347 of 2013 has been decided, therefore, in such circumstances, we are of the opinion that when the said Civil Suit has already been decided, hence there is no ground to stay the proceedings on the basis of the above Civil Suit. Accordingly, the revision has become infructous.  Hence, it is liable to be dismissed.

Accordingly, the revision petition is hereby dismissed as withdrawn. No order as to costs and the impugned judgment is affirmed.

File be consigned to the record room alongwith copy of this order.

A copy of this order be sent to the District Commission concerned for perusal and necessary information.

Both the parties shall appear before the District Commission concerned on 03.03.2023.
