Learned counsel submits that dispute involved in the case has been resolved between the parties out of Forum, therefore appellant does not want to pursue this appeal any more.  Learned counsel in view of  the above fact seeks to withdraw this appeal.  In view of the submission made by learned counsel the appeal is dismissed as withdrawn.
