None for Complainant ORDER Dated the 29th September, 2010 The OP has filed the present application for withdrawal of Rs.59,422/- deposited vide Pay Order No.0554852, dated 3.7.2009 and Rs.25,000/- deposited vide DD No.561533, dated 26.8.2008 in appeal No.887 of 2008 with consumer Forum. It is stated that the complaint of the complainant was allowed vide order dated 29.4.2008. Feeling aggrieved by the order of the Forum, the OP Corporation Bank preferred Appeal No.887 of 2008 before the Hon’ble State Comission and deposited Rs.25,000/-. The appeal was dismissed vide order dated 1.5.2009. Thereafter, the OP preferred Revision Petition No.2250 of 2009 before the Hon’ble National Commission and the National Commission vide its order dated 1.7.2009 stayed the operation of the impugned order subject to depositing half of the awarded amount with the District Forum. In pursuance of the order dated 1.7.2009 of the Hon’ble National Commission, the OP deposited Rs.59,422/- with this Forum and Rs.25,000/- was called from the Hon’ble State Commission and deposited with this Forum. It is further stated that the Revision Petition No.2250 of 2009 filed by the applicant/OP Corporation Bank has been allowed and order dated 1.5.2009 of the Hon’ble State Commission has been set aside. Therefore, it is prayed by applicant/OP that Rs.59,422/- and Rs.25,000/- may be released to them. Notice was issued to the complainant. Despite service the complainant has not come present, which shows that she has nothing to say on the application moved by the applicant/OP Corporation Bank. The application of OP is accordingly allowed. The amount of Rs.84,422/- (Rs.59,422/- + Rs.25,000/-) be released through cheque in favour of applicant/OP Corporation Bank against proper receipt.
