Revision Petitioner through Mr. R. K. Choumal, the Ld. Advocate and O.Ps through Mr. Amalendu Chakraborty, the Ld. Advocate are present.  On 27.07.2009 this matter was taken up in presence of the Ld. Advocate for both sides.  Considering the facts and circumstances of the case we found that the Revisionist was acting in a manner which cannot be supported by any Court or Forum/Commission.  When such view was being taken and being expressed, a prayer was made on behalf of the Revisionist for taking further instruction and matter was adjourned till today on such prayer.  Today Mr. Choumal, the Ld. Advocate appearing for the Revisionist expressed that his client does not want to proceed in this matter.  Therefore, we are of the view that the Revisionist is avoiding the compliance of the Forum order taking advantage of the technicalities, as the matter is not being proceeded the revision petition is dismissed for non-prosecution.  Cost assessed at Rs. 1,000/- payable by the Revisionist to the O.Ps for unnecessaryly harassing them.
