Appellant was the opposite party before the State Commission. Respondent/complainant’s case is that she had purchased an air ticket from the appellant by paying a sum of Rs.45,258/- for her travel from New Delhi to New York and back to New Delhi. She filed the complaint claiming compensation for mental and physical sufferings undergone by her due to delayed flight because of which she could not board the connecting flight and had to take a tortuous and circuitous route as she was taken to Rome from Paris and from Rome to London and from London to New Delhi. It was further alleged that she had not been provided any service by the petitioner. State Commission directed the petitioner to pay a compensation of Rs.50,000/- inclusive of cost of litigation. By our order dated 13.12.2005, we had stayed the operation of the impugned order subject to payment of Rs.25,000/- to the respondent. Respondent, who is appearing in person, states that she has received the sum of Rs.25,000/-. Counsel for the appellant states that the matter has been settled between the parties outside the Court and, accordingly, the judgement in appeal be set aside and the complaint be dismissed and the sum of Rs.25,000/- deposited by the appellant before this Commission at the time of filing the appeal be released in favour of the respondent along with accrued interest. In view of the settlement arrived at between the parties, the appeal is allowed and the complaint is ordered to be dismissed. Office is directed to pay the sum of Rs.25,000/- deposited by the appellant vide Demand Draft No.259057 dated 16.11.2005 to the respondent along with accrued interest, if any. Appeal is disposed of in above terms.
