Per Hon’ble Mr. Justice R.C. Chavan – President:

     This Revision is directed against the order passed by the District Consumer Disputes Redressal Forum, Thane, whereby the Forum directed that the hearing of the complaint to proceed without written version of the Petitioner. 

We have heard the Ld. Advocates. We admit the revision and by consent have taken it up for final hearing.

Petitioner had appeared before the Forum on 25^th August, 2012 but failed to file any written version on 25^th February, 2013.  The excuses given are indeed lame and none appeared before the Forum on 25^th February, 2013.  However, in the interest of justice since it is desirable to have the complaint decided on merits, though the Ld.Counsel for the Respondent/Complainant has objection we allow this petition subject to payment of further costs of `4,000/- to be paid within a period of two weeks to the Respondent/Complainant.  If the costs are paid, the District Forum shall receive the written version of the Petitioner.
