This FA coming up before us for final hearing on 18.11.2020 and this Commission made the following:-

The above appeal is filed by the Appellant along with a petition in CMP.No.329/2019 for condoning the delay of 633 days. This Hon’ble Commission by its order dated 07.01.2020 made in CMP.No.329/2019 had directed the petitioner/appellant to pay a cost of Rs.10,000 to the Respondent/Complainant. The Respondent refused to receive the said cost imposed by the Hon’ble Commission.
Therefore vide order dated 10.02.2020, the petitioner was directed to deposit the cost of Rs.10,000/- to the Legal aid account of the SCDRC. Pursuance of the order the petitioner has deposited cost of Rs.10,000 infavour of the Registrar SCDRC, Chennai. Consequently the delay was condoned and the petition was allowed as per the order dated 13.02.2020 and the Registry was directed to number the FASr as FA.49/2020.
The Respondent/Complainant in the above CMP having not agreed to the order passed in CMP.No.329/2019 has preferred RP.No.384/2020 before the Hon’ble National Consumers Disputes Redressal Commision. Subsequently the Hon’ble National Commission by its order dated 17.09.2020 has allowed the above RP filed by the Revisioner Petitioner / Respondent therein and had set aside the order in CMP.No.329/2019 dated 07.01.2020.
In view of the order passed by the Hon’ble National Consumers Disputes Redressal Commision in RP.No.384/2020 dated 17.09.2020 this appeal is dismissed. There is no order as to cost.
