ORDER

Per Hon’ble Mr. P.N. Kashalkar, Presiding Judicial Member :

           We direct Appellant to take steps to file necessary amendment application so that legal heirs could be brought on record.  However, this matter was adjourned from 8.2.11 till today.  No steps have been taken to file any such application in this behalf.  Since legal heirs have not been brought on record, appeal stands abated against Respondent No.s 1 & 5.

      

          We heard both the counsels on merit.  We are finding that order was passed by the District Consumer Disputes Redressal Forum in complaint No. 283/99 dated 30.9.99 is correct.  Complainant had filed consumer complaint claiming refund of certain money they had deposited acting upon the advertisement by the Appellant for plots.  Said claim could not materialize since Govt. of Maharashtra approved for the said project.  Ultimately, Forum held that there is deficiency in service on the part of the Appellant in not refunding the money deposited by the Complainants.  In the  circumstances, Forum was pleased to allow the complaint and directed Appellant to refund the amount of `2000/- each to all Complainants and/or `24,000/- to Complainant No.3 within three months from the date of order.  After three months, said amount was to carry at the interest @ 10% p.a.  There is no legal ground on which Appellant can validly assail the order passed by the Forum.  In the circumstances, we pass the following order :

          Appeal stands dismissed with no order as to the costs.
