[1]     Complainant absent. Counsel for Opponent present. After going through all the documents and entire proceedings, it  appear that Complainant is absent on last so many dates.  On perusal of Rojnama dtd. 13/12/2021 it appears that the Complainant was given last opportunity to file Affidavit Of Evidence. However, on 04/03/2022, 24/06/2022, 10/08/2022, Complainant remained absent.  Hence, on 10/08/2022, Close Evidence order is passed.  Thereafter,  also on all consecutive dates i.e. on 17/10/2022, 22/12/2022, 27/04/2023, 02/08/2023, 30/10/2023, 23/04/2024 and as also on today Complainant is continuously remained, which shows that the Complainant is not interested to proceed with the matter.   

[2]   With the aforesaid discussion, the complaint is disposed off as dismissed in default with the following order :

1. For want of the presence of the Complainant , the complaint stands dismissed in default.

2. No order as to as to costs

3. The certified copy of this order  be furnished to both parties free of cost

4. The Complainant to collect Member Sets ( if any),  within a period of 30 days from the date of receipt of the copy of the order.
