On perusal of records and after having heard the oral arguments of the Counsel for the Complainant, we delivered the following:
ORDER
Pronounced by the President Tmt. B. Jijaa, M.L.,
1. The Complainant has filed this complaint as against the Opposite Party under section 12 of the Consumer Protection Act, 1986 and prays to refund the 50% of the course amount of Rs.15,000/- to the Complainant and to pay Rs.1,00,000/- as compensation for the spoiling Complainant’s education, mental agony and sufferings along with cost.
2. The averments of Complaint in brief are as follows:-
The Complainant is a M.Com., M.Phil., Graduate aspiring and he is waiting for suitable jobs as Assistant Professor of any college for which as per the Government norms, UGC-NET University Grants Commission (National eligibility Test) conducted by the NTA (National Testing Agency). On 19.03.2019 he approached the Opposite Party Mr.Saravana Perumal who assured to take class and informed that it was a six month course in which period they would cover all the subjects and assured him to win the examination. On 20.03.2019 he joined in the Opposite Parties Academy by paying a sum of Rs.30,000/-. After getting admission he regularly attended the class. Suddenly on 02.10.2019 the Opposite Party asked to pay additional amount of Rs.30,000/-. The Complainant was very much shocked because even though his family in a poor situation he somehow managed to pay the entire fees of Rs.30,000/- but the Opposite Party asked to pay the the additional amount without completing 50% of the course subject. When the new batch of student joined in the Opposite Parties academy he was taking class from the beginning for the new batch of students and Opposite Party forced the Complainant to attend the class along with the new batch student which was already taught by the Opposite Party to the Complainant. Though the duration of 6 month was over the Opposite Party have not completed the 50% of the course thereby committing breach of trust. The Opposite Party has spoiled the entire life of the Complainant and hence the Complainant requested to refund a sum of Rs.15,000/- for not completing 50% of the course. Hence the Complainant raised the question for not completing the course within 6 months, the Opposite Party started threatening the Complainant. The Complainant lodged a Police Complaint against the Opposite Party on 04.10.2019 before the Inspector of Police, R2 where the Opposite Party agreed to take remaining part of the course to the Complainant. Hence the complaint was closed. On 05.10.2019 when the Complainant went to the Opposite Party academy to attend the class after finishing the class at 5 p.m one Mr.Sivaprakash, the representative of the Opposite Party informed the Complainant that he should not attend the class thereafter, which was reiterated by the Opposite Party and threaten with the dire consequence. The Complainant continues to attend the classes. The Opposite Party being a reputed company has not follow the condition of the course subject which amounts to deficiency of service and unfair trade practice. Hence the complaint.
3. The Complainant submitted his Proof Affidavit and Written Arguments. On the side of the Complainant, documents Ex.A-1 to Ex.A-8 were marked.
4. The Opposite Parties did not appear before this Commission even after sufficient notice to them. Hence the Opposite Parties were set exparte .
5. Points for Consideration
1. Whether there is deficiency in service on the part of the Opposite Party?
2. Whether the Complainant is entitled for reliefs claimed?
3. To what other reliefs the Complainant is entitled to?
