Heard Mr..J.M.Baphna-Advocate for the appellant and Mr.A.V.Vishwanathan-Advocate for respondent no.2.

Both the counsels admit that the original complainant has expired in the year 2006.  His heirs were not brought on record. Therefore, appeal no.1785/99 preferred by the original complainant is hereby abated. Respondent no.1 has also filed Appeal bearing no.1963/99.  In the said appeal said appellant has not brought on record heirs of the original complainant.  In the result, both the appeals stands abated and they are disposed of as abated.  Since the appeals are abated amount which is deposited by the parties at the time of filing appeals may be returned to them, if at all deposited by them. 

Copies of the order be furnished to the parties.
