Aggrieved by the order in CC No.474/2008 on the file of District Forum-III,Hyderabad, the opposite party preferred this appeal.

The case of the complainant in brief is that the complainant joined as a Member in the scheme floated by the opposite party and paid an amount of Rs.90,000/- for purchase of a plot atGolfVillage.  The matter has been taken to the Alternative Consumer Redressal Department of Consumer Affairs and Civil Supplies for settlement under non-legal measures and the said agency issued three notices but the opposite party did not turn up.  

Opposite party inspite of notice being served did not represent their case and was set exparte.

The District Forum based on the evidence adduced i.e. Exs.A1 to A5 and the pleadings put forward, allowed the complaint in part directing the opposite party to refund Rs.90,000/- with interest @ 12% p.a. from the date of payment i.e. 31-5-2008 till realization together with costs of Rs.2,000/-.

Aggrieved by the said order, the opposite party preferred this appeal.

Heard both the counsel.

The learned counsel for the appellant contended that the Membership card bearing No.DT 13859 was issued to the complainant and he can avail accommodation for one week for five years in studio type of apartment specifically mentioned in the terms and conditions   

A perusal of the record evidence that Rs.90,000/- was paid       

In the result this appeal is allowed in part and the order of the District Forum 

The learned counsel for the appellant submitted that it has already deposited the amount before this Commission and the complainant may be permitted to withdraw the same together with accrued interest, if any.
