Heard Mr.Suhas Deokar-Advocate for the appellant.  Mr.S.B.Prabhawalkar-Advocate for respondent no.2 to 4. Ms.Suvarna Joshi-Advocate for respondent no.1 states that respondent is dead and she has already informed the appellant about the death of respondent no.1-Mr.M.K.Subramaniam on 01/10/2012.  According to her, respondent no.1-complainant died on 05/03/2012.  After such intimation given, her role as an advocate representing respondent no.1 comes to an end.  Appellant did not bring legal heirs on record.  Further, referring to the order sheet dated 27/08/2008 after condonation of delay, appeal was admitted only against complainant/respondent no.1 and not against respondent no.2.  With this reason since the sole respondent is dead, appeal abates.  It stands disposed of accordingly.
