          This opposite parties were served, called absent and set exparte before this Commission.  For setting aside the expare order, petitions have been filed by the opposite parties 1 & 2 through Counsel.  While the petitions are pending to be decided, both parties had requested to post the matter  before Lok Adalat for settlement.  Since the matter is settled before Lok Adalat, the matter is placed before this Commission today along with settlement Memo received from Mediation Center upon perusing the Memo, this Commission made the following order in the open court:

Both  present.  Today, when the matter is taken up for consideration, it is represented by both the Counsels that the matter has been settled between the parties before Lok Adalat which was held on 15.12.2021.  The terms of settlement reads as follows:

Both parties were present.   The issue regarding rectification of sealing leakage noticed in all the four flats were discussed by both parties.  The complainant informed that the opposite party shall supply the materials and the same could be utilized by the opposite party only after certification from their Engineer, Mr. K. Natarajan.

The opposite party agreed and consented for the same.   Further, the opposite party agreed to authenticate the report which would be submitted to him on inspection /identification of defective areas on joint inspection, prior to commencement of the repair work.

The Counsel for complainant who was not present but contacted Lok Adalat Member over his mobile phone consented and agreed to the above proposal and the case has been compromised / settled by mutual consent by the parties.

In view of the above Terms of settlement, the C.C. is disposed off.   The Terms of Settlement form part of the Order.
