Evidence on affidavit is filed by the Ld. Advocate of the OP with copy to the Ld. Advocate of the complainant.
One application for appointment of Pleader Commissioner for inspection of the ground floor of the plot in question is filed with copy to the Ld. Advocate of the complainant.
The said application is registered as MA/177/2022.
After hearing the Ld. Advocate of both sides and perusing the aforesaid petition, we find that for the ends of Justice, the inspection on the ground floor of the suit property is required to be conducted by the a Pleader Commissioner to bring about the truth.
As such, Ms. Madhumita Saha is appointed as Pleader Commissioner for carrying out the aforesaid inspection work and she will get consolidated fees of Rs. 7,000/- payable by the Ops.
The Ld. Advocate of the OP is directed to supply a copy of this application and copy the agreement to the Ld. Pleader Commissioner within 7 days hence.
The Pleader Commissioner is directed to carry out the inspection work for completion of formalities and also to submit a report in this regard by 05.12.2022.
The MA 177/2022 is thus disposed of.
